Terms of Use

1. Provider and Acceptance

Kartnote is provided by Nordlate Oy ("Nordlate", "we", "us", or "our").

By downloading, accessing, or using Kartnote, you agree to these Terms of Use. If you do not agree, do not use the app. Apple's Standard Licensed Application End User License Agreement also applies and is incorporated into these terms. These terms supplement that agreement.

2. Eligibility

You must be legally capable of entering into these terms. Kartnote is not directed to children under 13. If you are under the age of legal majority where you live, you may use Kartnote only with the permission and supervision of a parent or legal guardian. The parent or guardian is responsible for the minor's use of the app.

3. Kartnote Service

Kartnote is a karting logbook and analysis tool that lets you record and review information such as drivers, karts, tracks, sessions, lap times, setups, notes, and weather conditions. Some functionality is available free of charge, while features identified in the app as Kartnote Pro require an active subscription.

Features may evolve as we maintain and improve Kartnote. We may add, change, or discontinue features, provided that we do not limit your mandatory consumer rights. Current subscription features and pricing are shown in the app before purchase.

4. License and Permitted Use

Subject to these terms and the Apple Standard EULA, Nordlate grants you a personal, limited, non-exclusive, non-transferable, revocable license to use Kartnote on Apple devices that you own or control, as permitted by App Store rules, for personal or internal team use.

You must not:

• Use Kartnote unlawfully or to infringe another person's rights or privacy.
• Enter another person's data unless you have authority to do so.
• Copy, distribute, sell, sublicense, reverse engineer, or attempt to extract Kartnote's source code except where applicable law expressly permits it.
• Interfere with the app, its security, StoreKit, iCloud synchronization, or subscription verification.
• Use automated or deceptive means to abuse the service or bypass access restrictions.

5. Kartnote Pro Subscription

• Billing: Kartnote Pro is an auto-renewable annual subscription purchased through Apple's in-app purchase system. Payment is charged to your Apple Account at the price and in the currency displayed by the App Store when you confirm the purchase. Taxes may apply.
• Free trial: A one-month introductory free trial may be offered to eligible users. Apple determines eligibility. Unless you cancel before the trial ends, the subscription automatically converts to a paid annual subscription at the price shown when you started the trial.
• Renewal: The subscription renews automatically for successive one-year periods unless you cancel it at least 24 hours before the end of the current trial or subscription period. Apple charges your Apple Account for renewal according to its App Store terms.
• Cancellation: You can cancel in your Apple Account subscription settings. Cancellation takes effect at the end of the current paid period, and Pro access continues until then. Deleting Kartnote does not cancel a subscription.
• Price changes: Prices may change. Apple will provide any notice or request any consent required for a subscription price increase. A changed price applies as permitted by App Store rules and applicable law.
• Refunds: Apple handles billing and refund requests for App Store purchases. Refund eligibility is governed by Apple's policies and applicable law. Nothing in these terms limits any mandatory right to a refund or other remedy.

You can manage or cancel your subscription at Apple's subscription settings.

6. Your Content and Data

You retain ownership of information you enter into Kartnote. You grant Nordlate only the rights necessary to operate the app and provide requested functionality. Your content is stored on your device and, when available, synchronized using Apple's CloudKit through your private iCloud account as described in our Privacy Policy.

You are responsible for the legality, accuracy, and appropriateness of your content and for keeping backups or exports of information important to you. Synchronization and storage depend on your device, Apple Account, network connection, available iCloud storage, and Apple services. We cannot guarantee that data will never be lost, corrupted, or delayed.

7. Motorsport Safety

Kartnote is a recordkeeping and analysis tool, not a safety system, timing authority, engineering service, or substitute for professional judgment. Lap-time comparisons, setup history, weather entries, suggestions, calculations, and other app output may be incomplete, delayed, or inaccurate.

Do not use or interact with Kartnote while driving or whenever doing so would be unsafe. Always follow track rules, event regulations, manufacturer instructions, and the advice of qualified mechanics or other professionals. You remain responsible for inspecting the kart, confirming all settings and measurements, and deciding whether conditions and equipment are safe.

8. Third-Party Services

Kartnote depends on services provided by Apple, including iOS, the App Store, StoreKit, and iCloud. Your use of those services is also subject to Apple's terms and privacy policy. Nordlate does not control and is not responsible for the availability or operation of third-party services, except to the extent required by applicable law.

9. Intellectual Property

Kartnote, including its software, design, text, graphics, trademarks, and other content supplied by Nordlate, is owned by Nordlate or its licensors and is protected by intellectual-property laws. No rights are granted except for the limited right to use the app under these terms and the Apple Standard EULA.

10. Availability and Updates

We aim to keep Kartnote available and reliable but do not guarantee uninterrupted or error-free operation. We may release updates needed for security, compatibility, legal compliance, or functionality. The app may stop working correctly if you do not install required updates or use a supported version of iOS.

11. Disclaimers and Liability

To the extent permitted by applicable law, Kartnote is provided "as is" and "as available". We do not promise that app data or output is complete, accurate, suitable for a particular setup, or capable of producing a particular performance result.

Nordlate is responsible for loss or damage that is a reasonably foreseeable result of our breach of these terms or failure to use reasonable care. To the extent permitted by law, we are not responsible for indirect or unforeseeable loss, loss caused by inaccurate information entered by you, unsafe motorsport decisions, or the failure of services outside our reasonable control.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from intentional misconduct or gross negligence, or your mandatory rights under applicable consumer law.

12. Suspension and Termination

You may stop using Kartnote at any time. We may suspend or terminate access where reasonably necessary because of a material breach of these terms, unlawful use, security risk, or legal requirement. Where reasonable, we will give notice and an opportunity to remedy the issue. Termination does not remove obligations or rights that by their nature continue after termination.

13. Governing Law and Disputes

These terms are governed by Finnish law. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of residence, and you may bring a claim in any court available to you under applicable consumer law.

Please contact us first so we can try to resolve a concern. Consumers in Finland may also contact the Finnish Competition and Consumer Authority's Consumer Advisory Services and may refer a dispute to the Finnish Consumer Disputes Board.

14. Changes to These Terms

We may update these terms to reflect changes to Kartnote, legal requirements, or our business. We will post the revised terms here and update the effective date. If a change materially affects your rights, we will provide reasonable additional notice where required. Your continued use after the change takes effect constitutes acceptance only to the extent permitted by law.
